Welcome to GLOBALINK. By accessing our platform, subscribing to our membership plans, purchasing Token packs, or utilizing our creator intelligence tools, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not access or use our services.

1. Services Provided

GLOBALINK provides a B2B intelligence directory and outreach workflow platform for international cross-border brands, DTC retailers, and agencies. The Service indexes publicly available professional business contact information, channel performance metrics, and audience demographics of global digital creators across platforms such as YouTube, Instagram, and TikTok.

2. Nature of Digital Assets & Token Model

2.1 Hybrid Billing Architecture

• Monthly Subscription Tiers: Starter ($49/mo, 100 Tokens), Growth ($129/mo, 350 Tokens), and Scale ($299/mo, 1,000 Tokens + AI Outreach). Subscription Tokens refresh each billing cycle; unconsumed monthly subscription Tokens expire on the monthly renewal date.
• Add-on Token Packs: Purchased separately (50, 200, or 500 Tokens). Add-on Tokens never expire and carry over indefinitely.
• Deduction Priority: Monthly subscription Tokens are consumed first. Add-on Token packs are debited only after monthly quotas are exhausted.

2.2 Permanent Unlock Benefit

Unlocking a creator's verified business email debits 1 Token. Once unlocked under your account, access to that creator profile remains permanently unlocked at no additional cost.

3. Payment Processing & Auto-Renewal

3.1 Merchant of Record

Payments for GLOBALINK are securely processed through Creem.io, our designated Merchant of Record (MoR). Creem handles tax collection, currency exchange, and secure PCI-DSS Level 1 compliant card processing. GLOBALINK does not store full credit card numbers on its servers.

3.2 Recurring Billing Authorization

By choosing a monthly subscription plan (Starter, Growth, or Scale), you explicitly authorize Creem.io to charge your payment method on a monthly recurring basis until you cancel.

3.3 Cancellation

You may cancel recurring billing at any time via your Account Dashboard or by contacting customer support. Cancellation halts future billings while your current plan's benefits remain active until the end of the paid billing period.

4. Fair Refund & Token Policy

4.1 Digital Consumables Policy

Because contact data and computational intelligence are delivered instantly upon unlock, Tokens once consumed to unlock creator contacts, generate AI outreach, or export CSV rosters are strictly non-refundable.

4.2 Unused Balances

• New subscribers who have consumed zero (0) Tokens may request a 100% full refund within 7 calendar days of initial purchase.
• Accounts that have consumed less than 15% of their monthly Tokens may be considered for a proportional refund minus computational and processing fees ($0.50 + 4% gateway fee).
• Add-on Token packs are eligible for a full refund within 7 days only if 100% unused.

4.3 Refund Contact

Submit refund requests to [email protected] with your registered account email and Creem Order ID. We respond to all requests within 2 business days.

5. Acceptable Use & Anti-Spam (CAN-SPAM / GDPR)

5.1 Intended B2B Purpose

Contact information provided by GLOBALINK is intended strictly for legitimate B2B sponsorship inquiries, product review pitches, and brand partnership proposals.

5.2 Compliance Warranties

When reaching out to creators, you represent and warrant that you will:

• Comply with the US CAN-SPAM Act, the EU ePrivacy Directive / GDPR, and relevant international anti-spam legislation;
• Provide accurate sender identification and a valid physical mailing address in every outreach email;
• Respect creator opt-out/unsubscribe requests immediately upon receipt;
• Never transmit unsolicited bulk email (spam), deceptive subject lines, sexually explicit content, or fraudulent schemes.

5.3 Indemnification

GLOBALINK provides data and automation tools. You bear sole legal liability for the content, delivery, and frequency of emails you dispatch to creators.

6. Public Data Sources & Disclaimer

Contact emails indexed on GLOBALINK are gathered from publicly listed business inquiries sections of creators' social channels or official professional links. We strive for maximum accuracy, but channel metrics, engagement rates, and business contact status change dynamically. The Service is provided on an "as-is" and "as-available" basis without guarantees of creator response or campaign ROI.

7. Pre-Dispute Resolution & Chargebacks

If you believe a charge was made in error, you agree to contact us at [email protected] before contacting your bank. We commit to resolving verified billing errors within 3 to 5 business days. Unauthorized or fraudulent chargebacks without prior communication will result in immediate account termination.

8. Creator Opt-Out Rights

We honor creators' rights to privacy and profile removal. If you are a creator listed on GLOBALINK and wish to remove your profile from our search engine, please visit our dedicated Creator Opt-Out Page or email [email protected]. Requests are processed within 48 business hours.

Purchase Confirmation & Billing Support

The plan price, billing frequency, and Token allowance are displayed before purchase. A return to GLOBALINK from a checkout page alone is not proof of payment; access and balances must correspond to the confirmed transaction. If you were charged but cannot access your purchase, please contact [email protected] with your account email and order reference so that we can investigate.

For a refund or cancellation request, include your account email, order reference, and the action you are requesting. Cancelling future renewal and requesting a refund are separate actions: please specify if you need both. Refund eligibility remains subject to Section 4 and the Refund Policy; submitting a request is not confirmation that a refund has been issued. Approved refunds are processed through the original payment service, and the time to appear in your account depends on that service and your bank.

9. Data Processing Addendum (DPA) & Cold Outreach Compliance

This Data Processing Addendum ("DPA") governs all email communications, partnership inquiries, and creator outreach workflows initiated through the GLOBALINK platform.

9.1 Legal Roles: Client as Controller, GLOBALINK as Processor

For all outreach communications dispatched to creators via GLOBALINK's outreach assistant or integrated dispatch APIs:

• Client is the Data Controller: You (the Client/Brand/Agency) retain sole control over and responsibility for deciding which creators to contact, the promotional proposals offered, the subject lines and email content transmitted, and the frequency of communications.
• GLOBALINK is the Data Processor: GLOBALINK acts strictly as a technical intermediary and data processor carrying out communications solely upon your documented instructions and configuration.

9.2 Jurisdiction-Specific Marketing Compliance Warranties

As the Data Controller, you explicitly represent, warrant, and covenant that all emails dispatched through our tools comply with the mandatory direct-marketing legislation of the recipient's jurisdiction:

• United States (CAN-SPAM Act 15 U.S.C. 7701): You must include a valid physical postal address of your business, ensure truth in advertising and subject headers, and honor opt-out requests within ten (10) business days.
• Germany (Gesetz gegen den unlauteren Wettbewerb - UWG § 7): Unsolicited electronic advertising to German businesses or creators is strictly prohibited without prior explicit consent (ausdrückliche Einwilligung), unless strictly falling within lawful B2B product testing or existing business engagement exemptions. You agree not to send cold marketing broadcasts to German creators without legal justification.
• United Kingdom (PECR / UK Data Protection Act 2018): Direct B2B marketing emails to corporate entities are permissible only if an immediate, simple opt-out mechanism is provided and the communication is directly relevant to their business role.
• France (CNIL Guidelines) & European Union: Direct B2B contact must be directly linked to the recipient's professional activity or published sponsorship scope and must disclose data origin alongside an immediate objection route.

9.3 Mandatory Email Footer & Opt-Out Invalidation

To preserve commercial deliverability and protect creator rights, all outreach emails generated through GLOBALINK automatically include:

• Identification of the sender's brand entity and direct Reply-To contact routing;
• An automatic, tamper-evident One-Click Opt-Out & Profile Removal Link directing to our centralized suppression portal.

You are strictly prohibited from attempting to strip, disguise, or manipulate the platform's mandatory compliance footers.

9.4 Platform Suppression List Enforcement

GLOBALINK maintains a global suppression blacklist. When a creator exercises their GDPR Article 17 right to erasure or unsubscribes from outreach, their email is placed onto our automated suppression registry. The platform will automatically reject and block any future outreach attempts directed to that creator across all client accounts.

9.5 Comprehensive Indemnification

You agree to defend, indemnify, and hold harmless GLOBALINK, its directors, employees, and payment partners against any third-party claims, administrative fines, legal fees, or damages arising from your failure to comply with global anti-spam regulations, deceptive pitch materials, or unauthorized commercial contact.
